"Mich. to allow seizure of guns from people deemed to be at risk: New 'Red Flag" law will let people petition for temporary confiscation." Detroit News 5/23/2023.

Three take ways from the article :

The bill -signed , sealed and delivered in Royal Oak yesterday, won't take effect until Spring 2024. If this bill is so necessary to save lives why a year for its implementation?

"Some" lawmakers worry that the bill will and with bias lead to the unfair targeting of minority communities resulting in the bill's final language "...requiring a demographic study of the law's application." ????????????

Various supporters of the bill were quoted in the article as saying: ( paraphrased for brevity) "...the conversation is not over...these policies are not a ceiling but a floor...on the horizon...gun purchase waiting periods . "

It won’t just be minorities targeted, all gun owners are the target.

I also see in the language of the process of petitioning the judge that it could take 24 hrs.for the action order to be issued, and some legislators were quoted as saying this bill is not the ceiling, it’s the floor. That statement is telling!

And when these warrants are signed and LEO s have to attempt to seize these weapons, I hope no one gets hurt in the process but I’m seeing tragedies in our future on both sides. I know how I would handle things but it’s not my game anymore.

My biggest concern here isn't me, it's the people in poor/****** neighborhoods. They may have had previous problems due to where they live. Now they can have their only protection can be taken away.

Right on. At the point I have to knock on a door to confiscate an "alleged" reported violation that may be just a BS report, I'm out of the game. Retirement is imminent. Let a LE officer show up to take my guns because a property line dispute caused hurt feelings and someone made a report that I threatened them. That's what's gonna happen. Your correct, I know how I'd handle that scenario. All a LE officer has is his gut in these types of scenarios. Reports mean nothing in today's world of gun banning and anti gun rhetoric. This is not gonna go well when that scenario shows up.

From my knowledge of how RED FLAG LAWS work, there is ""supposed" to be a hearing involved for both parties (complainant/defendant) to determine whether or not "confiscation" is warranted! I don't know if the bill passed by passes the hearing and jumps to straight confiscation first then a hearing afterwards to get the gun(s) back?

Not when there's no repercussions to the accuser when falsely accused.

It's just another front for gun confiscation

They know legal fees/time lost will outweigh the price of most guns so the accused won't bother, it's part of their plan...

Red flag laws are the most unconstitutional thing we have ever seen passed.

No you do not get a hearing before hand. It allows authorities to go directly to a judge without your knowledge and get permission for a no knock Warrant to confiscate your guns

This means at 1 am swat breaches your house and takes all your weapons, all your family is drug from their beds and detained until the search is completed and they are satisfied all guns have been seized.

And you do not have to commit a crime for this to happen. Simply a whisper from a nosey nieghbor saying they think you may do something is all it takes.
No mental evaluation first. No court date, just outright seizure and then you can try to prove you have no issue and Good luck getting your guns back

This is not an exaggeration it has been happening out in I believe Maryland, maybe Delaware I don't recall. But cops have been shot entering houses trying to do confiscations and nobody is a winner here.

It's a direct violation of your rights to a fair trial and innocent until proven guilty

All in the name of gun control

We are loosing our constitutional rights

There was one in MD where the gun owner came to the door with a revolver and when he was asked to hand it over he got agitated and he fought it. The officer killed the gun owner, fearing the gun owner was going to use the gun he brought to the door.

If someone flagged to have their weapon taken comes to the door with one, they're probably unstable.
