Lawmaker wants ND hunting rights and land split



BISMARCK, N.D. - A legislator from western North Dakota wants an opinion from the attorney general on whether hunting rights can be sold separately from land.

Democratic Rep. Rod Froelich of Selfridge wrote a letter to Attorney General Wayne Stenehjem asking for a ruling on a state law banning the practice.

The issue is whether hunting rights can be "severed" and sold separately as is sometimes done with mineral rights and surface owner rights.

The 2007 Legislature put a two-year moratorium on the practice and an interim study committee has voted to consider making the ban permanent.

Froelich says the ban violates property owners' rights to do what they want with their land.
