Court Opens Door To Searches Without Warrants

NEW ORLEANS -- It's a groundbreaking court decision that legal experts say will affect everyone: Police officers in Louisiana no longer need a search or arrest warrant to conduct a brief search of your home or business.

I'm a law abiding citizen but this sure as heck seems like a REAL slippery slope if you ask me.

New Orleans Police Department spokesman Capt. Marlon Defillo said the new power will go into effect immediately and won't be abused.

Yeah right.
Even if Marlon could be trusted not to abuse this, who's to say the next person to take his place wouldn't. My signature reflects my opinion about this as well as anything else I could say about it.;)

Without reading the whole case, it seems that the police were acting on reliable information to enter this mans home. Threats to judges and public utilities are not wise. Can this type of police behavior be abused? YES. It appears that the police did a little background investigation and this man's past gave them an indication that his threats were in fact possible and he could be a threat.

If they ignored this information and he killed someone or blew something up, they would have been remiss in their duty. Look what happened on 9-11

It appears that they searched the home for the person, then received a signed consent form to search the home and seize the weapons. Without the consent form, it would have been wise to secure a search warrant.

IV Amendement states: The right of the people to be secure in their person, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated. Warrants shall issue, but upon probable cause, supported by oath or affirmation, and particulary describing the place to be searched, and the persons or things to be seized. (the key word is 'unreasonable')

Hamilton it is good to know what various government agencies are up to, thanks for the post. If we snooze we lose:o It seems that the "Patriot Act" literally trashed the Constitution, hopefully the legislators will close some of the gaps created by this act, if not we will probably see more "search" cases before the courts.:rolleyes:

Just an opinion on this particular case.:confused:

Dick, I come across many articles that catch my curiosity, but may not tell the whole story in one article. I then post the article which may lead to responses and other articles to fill in any missing material. That's the most important funtion of this forum. We can all learn together that way. I've also noted that many times an article will show up here and then on the TV news in the next day or so. I saw this article topic on TV today.
