Contact your local Fire Department or US Coast Guard Office. This is what it says on a lot of boating sites.

I don't have a boat anymore but I used to always make sure I had current flares on board. But I also kept the expired ones too. I figured that if I ever needed a flare, I'd start by using the expired ones first. They will probably work. But if they didn't I'd break out the current ones. I know that you only have room for so many flares on board but I usually bought the three packs of flares. I figured it never hurt to have a few extra on board just in case.

Federal law says your flares cannot be expired. If you have valid flares, you can still keep the expired ones on board as well. They will most likely still work if they have been stored properly.
The one thing I wouldn't do is just shoot them off to use them up.....for obvious reasons.:)

Actually all individuals on board should be familiar with the flares and use of the VHF in hailing the CG for an emergency. I used some of my old flares to have my three boys become familiar with ignighting and holding them so that no injury or damage will occur in they're use. They have also been instructed on the VHF and how to contact the CG in the event that I or anyone else becomes incapacitated. Should you have a serious medical emergency you may not be able to direct individuals on board waht needs to be done when help is needed. Maybe I'm overly cautious, if thats possible.

No it's not.

Good plan!

If you have no desire to retain them, take them to your local fire department and they will dispose of them for you.
