I am starting this here as it kinda got off track in the other forum.
Are you or are you not responsible for you vessel's wake damage.
I believe that you, as a operator of a vessel, must always be aware of your vessels wake and make speed adjustments if necessary. Bottom line is you are responsible for the actions of your vessel!!!!
As I said before, I was a wittiness in a case that the US Coast Guard ( well the feds) brought against a freighter company. Seems like the USCG would have a pretty good idea on the law.
I had my captain license ( tonnage) years ago and the schooling we had to take was great! I wish all boat owners were required to take 1/2 the course we had to. It would make boating SAFER by far. People seem think that just because there are no lines on the water ways there are no rules. SORRY - but there are.
I remember one time I had a guy coming from my stern, angled, but not as to be an overtaking vessel , on my port side, he was the burdened vessel and I was the privileged vessel he is required to check his speed and proceed to cross behind me. He choose to run right up to my port side and us an ear full on what a$%$ holes we were and that we did not know the boating laws. Had I known the guy was going to do that I would have just given way as not to have my charter see that outburst.
