The rules for posting property!! I posted are 08 lease today with signs that read "NO HUNTING OR TRESPASSING" Then I wrote on a few of them hunting rights leased! Thought I was doing the right thing being that I found out a guy has been hunting this track of land without permission..But my Dad tells me that if I post it no hunting the DNR can ticket :yikes:us ..Is there any truth to this..I leased this area before and never had a problem but this time I did find two homemade stands up that were not suppose to be there! I just want to make sure I have my bases covered..thanks!

Yes you can post the property if you are leasing it. Your best bet is to have the lease papers or permission signed from the property owner that states you are the person or persons leasing the property, that way you have legal proof to show any person or persons you find trespassing that you are leasing the property, and yes you do have every right to make them leave the property.

I do not think that you have a problem putting the signs up. But I thought I read about only the land owner of the property can bring tresspas charges should you catch someone. So might want to make sure that he is aware and supports your marking of his land.

No the DNR cannot ticket you (what would it be for?). Here's the law on recreational trespassing that should answer some questions for you:

And some info from the DNR site:

if you want i cant be your propertys first line of security....you know kinda like its body guard... im going to need hunting rights to it also though :)... as far as i know you can post it like said earlier and yes the land owner is the one who can press the charges... but you can still call the cops on them...

No truth to it. It doesn't matter what the signs say you have permission or you don't.

The myth of signs saying NO HUNTING means nobody can hunt is all it is, a myth.

This has been discussed a few times before, search the Law Forum and you will find the discussions.

It has always been my understanding that you do not have to post the land. If you don't own it, you can't trespass on it. Posting and fencing just makes it more obvious to the ignorant.

If you own it and put it in CFR then it's open land for anybody to walk on.

Benson (who managed the 390,000 acres of land in the U.P. that the Hawaii Kamehameha Schools Trust bought in the '90's) got into trouble with the DNR regarding property I hunted. He put the land in CFR and then fenced it along highway 28 with white split rail fencing and locked the gate on the access road. The DNR made him take the fence down and unlock the gate.

Posting and fencing just makes it more obvious to the ignorant.Unfortunately it would be nice if it was that way but under state law it is not that way. If the land is not posted and is not one of the exceptions, farmland and adjacent wood lots to farmland, if it isn't posted a person can not be prosecuted for trespass.
