smelt fishing on Higgins

Has anyone ever speared smelt when they wern't bitting. I was just thinking the other day about it. Some times the smelt just don't bite. They swim to your bait:fish: :fish: , look, turn, and then swim away. Now if I had a spear they would'nt swim away, i'm think'n. I'm not sure on the laws, about spearing smelt. Does anyone know.
